4. PUBLIC HEARINGS
4.1. HEARING TO APPROVE THE 2020-2024 HUD CONSOLIDATED PLAN The City of Chico is an entitlement grantee for the receipt of federal funds through two programs administered by the U.S. Department of Housing & Urban Development (HUD): Community Development Block Grant (CDBG) and Home Investment Partnerships Grant (HOME). As an entitlement grantee, the City's receipt of funds is contingent upon City compliance with a variety of planning and administrative requirements. One of the requirements is the submission of a "Consolidated Plan" every five years, including the first Annual Plan for 2020-2021, and a review of the Analysis of Impediments to Fair Housing. At its May 5, 2020 meeting, the City Council conducted a hearing on the draft 2020-2024 Consolidated Plan and directed staff to schedule a second hearing for adoption of the Plan at its meeting on June 2, 2020. 4.2. HEARING TO CONSIDER THE FINAL ANNUAL ENGINEER'S REPORT AND THE LEVY AND COLLECTION OF THE 2020-21 ASSESSMENTS FOR THE HUSA RANCH/NOB HILL NEIGHBORHOOD PARK LANDSCAPING AND LIGHTING DISTRICT NO. LLD 001-08. On 5/02/20, the City Council adopted resolutions approving the preliminary Annual Engineer's Report ("Report") and declaring its intention to levy and collect the annual assessments for the Husa Ranch/Nob Hill Neighborhood Park Landscape and Lighting District No. LLD 001-08 ("LLD") for the 2020-21 fiscal year. The Council also scheduled tonight's public hearing to consider approval of the final Report and the proposed annual levy of $66.06/parcel, which is the same assessment as 2019-20. 4.3. HEARING TO CONSIDER A RESOLUTION TO TEMPORARILY CLOSE OLD HUMBOLDT ROAD TO VEHICLES PURSUANT TO CHAPTER 10.53 OF THE CHICO MUNICIPAL CODE City of Chico staff, Butte County staff, and elected officials assigned to the Local Government Committee have discussed impacts of littering and criminal activity on Old Humboldt Road on numerous occasions starting in 2017. The easterly upper portion of the road is County jurisdiction and the westerly lower portion is City jurisdiction. Resources from both agencies are commonly deployed to deal with illegal dumping and nefarious activity on this road that serves no access for essential through-traffic or services. On 2/4/20, the Chico City Council adopted Ordinance No, 2546 amending Title 10 of the Chico Municipal Code adding Chapter 10.53 relating to temporary road closures. Under the new code, the City Council by resolution may temporarily close streets and roads to address criminal activity and illegal littering/dumping for 18-months at a time, and may renew such closures for additional 18-month periods up to eight times.

4.4. HEARING TO CONSIDER ACCESSORY DWELLING UNIT ORDINANCE AMENDMENTS Several bills went into effect on January 1, 2020, affecting the development regulations for Accessory Dwelling Units (ADUs) and Junior Accessory Dwelling Units (JADUs). These new State regulations limit the ability of local jurisdictions to issue discretionary approvals, increase allowances and define standards for ADUs and JADUs. Local ordinances that do not conform to the new State laws are null and void. While the City currently has regulations in place to allow for ADUs, further amendments to these regulations are required for consistency with the new State housing laws. 5.2. ORDINANCE ADDING CHAPTER 3.90 TO ESTABLISH A ONE-CENT SALES TAX On November 20, 2018, the City Council approved a Finance Committee recommendation to engage a professional consulting firm to conduct a tax feasibility voter survey of City residents to determine the viability of passing a tax measure and on April 16, 2019, the City Council directed the administration of a voter survey for a 1 cent sales tax measure. EMC Research conducted the voter survey and on October 15, 2019, EMC presented the results to the City Council which indicates support for a 1 cent sales tax measure in November 2020. The City Council acted to direct City staff to prepare the necessary documentation and related actions to place a 1 cent general sales tax on the November 2020 ballot. The requested action would initial the formal requirements to proceed with the measure. This action requires 5 affirmative votes. (Report - Chris Constantin, Assistant City Manager)
